Fair Use

EyeJack Fair Use Policy

EyeJack Creator comes with a FREE plan which gives every user with an account, 300 free views per month for all their artworks.

A View is when an AR artwork is activated, and the viewer sees an AR animation played on top of the artwork.

Currently, EyeJack Creator offers three core plans to all users; these are:

FREE Plan 

  •       300 free views per month
  •       The monthly period starts once an account has been created


Artist Plan 

  •       $10 per month for up to 10,000 views
  •       Additional Views beyond the monthly allowance are $0.01 per View.
  •       The monthly period starts from when payment is made
  •       Includes collection publishing


 Company/Organisation 

  •       $100 per month for up to 100,000 views
  •       Additional Views beyond the monthly allowance are $0.01 per View.
  •       The monthly period starts from when payment is made
  •       Includes collection publishing

Application of this Policy

This Policy is designed to protect the quality and integrity of EyeJack Creator in order to ensure that all users receive a fair and quality service. In doing so, this Policy regulates your right to access and make use of EyeJack Creator in a manner that promotes the responsible use of EyeJack Creator and any content and/or material used by you in accordance with Our Privacy Policy and Terms & Conditions.

We may depend on our Fair Use Policy in circumstances where your usage that forms part of a plan or service is deemed to be 'unreasonable' or 'excessive' as defined by Us.

We retain the right to vary the terms of the Fair Usage Policy at Our discretion from time to time.


Unreasonable Use

 EyeJack considers unreasonable and excessive:

  • creating and/or publishing any material which may be considered offensive, abusive, defamatory, indecent, obscene, unlawful, harassing or menacing or in a breach of the copyright, trademark, intellectual property, confidence, privacy or any other rights of any person and/or entity; and/or
  • knowingly or negligently creating, transmitting, storing, publishing or uploading any material that may disrupt, interfere, interrupt, damage, destroy or limit the functionality of EyeJack Creator; and/or
  • having more than one account per user and/or providing false or misleading information to create an account with Eyejack Creator and/or use Our services


Our Rights

If We consider that your use of EyeJack Creator or any related service is unreasonable, excessive or in breach of this Policy, we may at Our sole discretion:

  • provide a warning notice to stop or moderate any unreasonable and excessive use of EyeJack Creator; and/or
  • suspend or limit your access to EyeJack Creator; and/or
  • terminate your account in accordance with Our Terms & Conditions.


Your Responsibilities

You are responsible for the fair and responsible use of EyeJack Creator, including but not limited to, the creation and/or publication of any material from your account.

Sharing, regulating or limiting the access to your account from any third party and/or associate, including but not limited to, the use of any content, material, creation and/or publication from your account.

Protecting and ensuring your account information remains secure and confidential


Disclaimer 

The EyeJack Creator Fair Usage Policy ("Policy") constitutes a binding and legal agreement between the end users (referred to in these Terms by “you”, “your”, “yours”, and their derivatives), and EYEJACK PTY LTD  identified with ABN 80 615 617 135 (referred to in these Terms as “Company“, “we”, “us”, “our”, “ours”, and their derivatives) in accordance to Our Privacy Policy and Terms & Conditions.
